The Hindu side of the long-standing dispute had requested an ASI study of the entire Gyanvapi mosque complex in a petition letter to the Varanasi court.
The Varanasi District Court today allowed the Archaeological Survey of India (ASI) to conduct a “scientific survey” of the entire Gyanvapi mosque premises, apart from the barricaded ‘wazukhana’ that holds a structure that Hindu litigants claim is a shivling. Four women worshippers filed a petition asking whether the mosque had been constructed over a pre-existing Hindu temple structure. By August 4, the ASI must submit its scientific report.
Higher courts are likely to challenge the order. Wazukhana was sealed last year by the Supreme Court.
As reported by news agency ANI, Vishnu Shankar Jain, representing the petitioners in the case, said “I have been informed that my application has been approved and the court has ordered that an ASI survey be conducted of the Gyanvapi mosque complex, excluding the Wazu tank, which has been sealed.”
A group of four women worshippers filed the application in May this year, claiming that Gyanvapi Mosque, located next to Kashi Vishwanath temple, had signs of an ancient Hindu temple. The application stated that Swayambhu Jyotirlinga existed at the site for lakhs of years, but was destroyed/damaged several times by “Muslim Invaders who had hatred against infidels and idol worshippers beginning with Mahmud Ghazni’s attack in 1017 AD.”.
The application further states that “one of the most fanatic and cruel Mughal Emperors, Aurangzeb” issued Farman (decree) in 1669 to demolish the Temple of Lord Adivisheshwar at the site in question and his subordinates carried out his command by demolishing the aforesaid Temple.
According to Mr Jain, an archaeological investigation of the entire mosque complex is the only way to resolve the Kashi Vishwanath temple-Gyanvapi mosque dispute.
An ASI survey could damage the complex, according to the mosque committee.
On May 19, the Supreme Court deferred a “scientific survey”, including carbon dating, of a “Shivling” found during last year’s videographic survey at Gyanvapi mosque complex.
In one of the main cases involving the Gyanvapi Mosque, the mosque committee suffered a huge setback when the Allahabad High Court dismissed a plea to scrap the civil suit.
The Varanasi District Court has ruled that the lawsuit filed by Hindu women worshippers in Varanasi seeking access to Gyanvapi mosque complex is valid.
