On Tuesday, the Lucknow bench of the Allahabad High Court quashed the state government’s draft notification on urban local body elections and ordered them to be held without reservation for OBCs. A division bench of Justice DK Upadhyay and Justice Saurav Lavania ruled.

On December 5, a division bench of Justice DK Upadhyay and Justice Saurav Lavania annulled the Uttar Pradesh government’s draft notification for the reservation of Other Backward Classes (OBCs) in urban local bodies.
PILs were filed challenging the preparation of the OBC reservation draft without following the triple test formula.
Before fixing reservations, the state government should follow the Supreme Court formula and set up a dedicated commission to study OBCs’ political backwardness.
According to the state government, it conducted a rapid survey that passed the triple test.
Earlier this week, the Lucknow bench stayed the city council elections for a fortnight.
During its winter break, the bench said it would hear the case since it relates to local elections.
The state government had earlier this month issued a provisional list of reserved seats for mayors of 17 municipal corporations, chairpersons of 200 municipal councils and 545 nagar panchayats for the three-tier urban local body elections and asked for suggestions/objections within seven days.
The December 5 draft reserved four mayoral seats for OBCs in Aligarh, Mathura-Vrindavan, Meerut, and Prayagraj. The mayor’s posts in Aligarh and Mathura-Vrindavan were reserved for OBC women.
The 200 municipal councils also reserved 54 chairs for OBCs, including 18 for women. A total of 147 seats were reserved for OBC candidates in 545 Nagar panchayats, including 49 for women.
Samajwadi Party spokesperson Sunil Singh Sajan said, “It’s a conspiracy by the BJP to deny reservation to the backward classes.”
