In response to numerous complaints regarding the collection of royalties by copyright societies for the performance of Hindi film songs at weddings, this directive was issued.
In a public notice, the Department for Promotion, Industry, and Internal Trade (DPIIT) announced that it has received several complaints and grievances from the general public and other stakeholders regarding the alleged collection of royalties by the Copyright Societies for the performance of musical works in marriage functions in violation of Section 52 (1) (za) of the Copyright Act 1957.
According to Section 52 of the act, certain acts do not constitute infringements.
Specifically, Section 52 (1) (za) states that the performance of literary, dramatic, or musical works in the course of any bona fide religious ceremony or official ceremony does not constitute an infringement of copyright.
A marriage procession and other social festivities associated with marriage are included in religious ceremonies.
To avoid legal action, Copyright Societies are directed to refrain from acting in contravention of Section 52 (1) (za) of the act.
This section also cautioned the general public against acceding to uncalled demands from individuals, organizations, or copyright societies.
