Uttarakhand Eviction: On Thursday, the Supreme Court halted an eviction drive in Uttarakhand’s Haldwani that threatened to leave thousands homeless during the harsh North Indian winter.

A Supreme Court ruling that stopped a Uttarakhand High Court order that had cleared the eviction of 4,000 people living in 4,000 homes after a case that went on for years said, “There can’t be uprooting of 50,000 people overnight… It’s a human issue, we need to find a workable solution.”

“It may not be correct to say paramilitary forces have to be deployed to evict people who have lived there for decades,” said the Supreme Court in response to the high court’s suggestion.

As well as stopping construction, the court asked the railways and Uttarakhand government for answers. Next month, the case will be heard again.

Justice Sanjay Kishan Kaul and Justice AS Oka took up the case a day after activist-lawyer Prashant Bhushan asked for it.

Residents who held candle marches, sit-ins and prayers to stop the eviction are relieved by the order.

Area includes Gafoor Basti, Dholak Basti, and Indira Nagar in Banbhulpura, near Haldwani railway station.

Aside from houses, nearly half of the families have a land lease. There are also four government schools, 11 private schools, a bank, two overhead water tanks, 10 mosques, and four temples, besides shops.

In 2013, a petition about illegal sand mining in a river near the area reached court.

After a long court battle, the district administration asked people to take their stuff away by January 9 following the court’s order on December 20.

Activists and politicians blamed the BJP government for targeting an area where most residents are Muslims.

Former chief minister Harish Rawat held a ‘maun vrat’ (vow of silence) at his home in Dehradun.

50,000 people, including children, pregnant women, old men and women, being forced to leave their homes is a very sad sight, he said.

The Supreme Court’s decision will be respected by Mr Dhami’s government.
